What is Personal Injury?
Personal injury is damage you sustain as a result of physical or psychological injury. This can occur due to a traffic accident, workplace accident, medical error, dog bite, or a fall in a public space. The damage can consist of medical expenses, lost income, as well as pain and suffering (emotional damages).
Am I Entitled to Compensation?
If someone else is (partly) responsible for your injury, you often have the right to compensation. This also applies if you were a passenger in a car or a victim of a dog bite. In some other cases, you may also be entitled to compensation. That’s why it’s important to always have this assessed by an expert like Justise.
Who is Liable for My Injury?
That depends on the situation. In a traffic accident, it could be the other driver; in a workplace accident, your employer; and in case of a fall in a store, the property owner. Justise will investigate this for you.
What if I Am (Partly) Responsible for the Accident?
Your compensation may be reduced, but you often still have the right to (partial) compensation. Extra protection is especially provided for cyclists and pedestrians.
What Does Personal Injury Cover?
For example:
Medical expenses (including deductibles)
Travel expenses to doctors or therapists
Loss of income
Household help
Costs for assistance or adaptations
Compensation for pain, fear, or grief
How much Compensation Will I Receive?
The amount of your compensation depends on your situation. We fully map out your damages and create a customized calculation. Regular advances are requested during recovery.
How Long Does a Personal Injury Case Take?
It depends on the severity of the injury and whether liability is quickly acknowledged. Some cases take a few months, others several years. We keep you informed and ensure you receive interim compensation where possible.
What Does Legal Help for Personal Injury Cost?
In almost all cases, our help costs you nothing. If the other party is liable, their insurer pays our costs. Only if we need to go to court might there be associated costs. We always discuss these with you in advance so you can choose whether to proceed with legal action or not.
Do I Need to Collect Evidence?
Yes, as much as possible. Consider:
Photos of the situation
Witness statements
Police report or statement
Medical statements
Bills and receipts for expenses incurred
How Long Do I Have to File a Personal Injury Claim?
You must file your claim within five years after the accident. Sometimes shorter terms apply, for example with public transport accidents (three years). So contact us in time.
What if I Can No Longer Work Due to My Injury?
If you have become unable to work due to the accident, you can receive compensation for lost income, pension accrual, bonuses, and more. This is called loss of earning capacity.
